DMCA & Copyright Policy

Overview

Tofido respects intellectual property rights and expects users and partners to do the same. If you believe content hosted or processed via Tofido infringes your copyright, please submit a notice as described below. We will review the report and take appropriate action, which may include removing or disabling access to the material and/or terminating repeat infringers where appropriate.

Scope

This Policy applies to user‑generated or third‑party content (collectively, “UGC”) that may be uploaded, stored, transmitted, or displayed through systems managed by Tofido. Contracted clients are responsible for ensuring that UGC they provide or enable on their properties complies with applicable laws and rights.

Before You Submit

  • Verify that you are the copyright owner or authorized to act on the owner’s behalf.
  • Consider whether the use may be permitted under exceptions such as fair use, quotation, criticism, news reporting, or license terms you granted previously.
  • Provide URLs and sufficient detail to help us identify the material accurately.

How to Submit a DMCA Takedown Notice

Send an email to [email protected] with the subject line “DMCA Notice.” Include all items below (in English, where possible):

  • Your full name and a statement of authority to act for the copyright owner.
  • Contact email (and, optionally, a mailing address) for correspondence.
  • A clear identification of the copyrighted work claimed to have been infringed (e.g., title, description, registration number if any, or a representative list if multiple works are covered).
  • Precise location(s) of the allegedly infringing material, including full URL(s) and any relevant account or project identifiers.
  • A statement that you have a good‑faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf.
  • Your electronic signature (typing your full name is acceptable).

Incomplete notices may delay processing. We may forward your notice (including contact details) to the user who posted the content or to the relevant customer whose project hosts the content.

What Happens After We Receive a Notice

  • We review the notice for completeness and plausibility.
  • We may remove or disable access to the content in question while we notify the user/customer and, where applicable, provide an opportunity to file a counter‑notification.
  • In appropriate cases, we may terminate or restrict accounts of repeat infringers.

Counter‑Notification (If Your Content Was Removed)

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter‑notification. Send an email to [email protected] with the subject line “DMCA Counter‑Notification” and include:

  • Your full name and contact email (and, optionally, mailing address).
  • Identification of the material removed or to which access has been disabled, and the location where the material appeared before it was removed or access to it was disabled (full URL).
  • A statement, under penalty of perjury, that you have a good‑faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your consent to the jurisdiction of the courts in your region (e.g., your state/country) and your agreement to accept service of process from the person who provided the original notice (or their agent).
  • Your electronic signature (typing your full name is acceptable).

Upon receiving a valid counter‑notification, we may forward it to the original complainant. Unless the complainant notifies us within a reasonable period that they have filed a legal action seeking a court order, we may restore the content.

Repeat Infringement Policy

Tofido may, in appropriate circumstances and in its discretion, limit, suspend, or terminate user accounts that are the subject of repeated infringement notices. We consider factors such as the number of notices, the time period, the nature of the content, and whether counter‑notifications were sustained.

Misrepresentations

Submitting false claims can have legal consequences. Parties who knowingly misrepresent that material is infringing (or non‑infringing) may be liable for damages, including costs and legal fees. Use these procedures responsibly.

Rights of Tofido

  • We may remove or disable access to content alleged to be infringing at our discretion.
  • We may notify relevant account holders, customers, or upstream service providers and share the notice/counter‑notice to resolve the matter.
  • We may preserve records and logs as necessary for legal compliance and dispute resolution.

Third‑Party and Client Responsibilities

Clients who host or enable UGC on properties managed by Tofido remain responsible for their content and for complying with copyright laws. Clients should maintain clear content policies, act on valid notices promptly, and ensure their users understand acceptable use rules.

Jurisdictional Notes

This Policy is designed to align with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) procedures and similar notice‑and‑takedown frameworks in other jurisdictions. Requirements may vary by region, but the core principles-notice, review, removal/disablement, and counter‑notice-generally apply. We will act in good faith to respect applicable laws.
